NYC DOB Now Allows Early FISP Filing for NRF Buildings
If your New York City building failed to submit a required Cycle 9 Facade Inspection Safety Program (FISP) report, you're likely accruing monthly DOB penalties. Fortunately, the Department of Buildings (DOB) has just announced a way to reduce those fines by filing early in Cycle 10, which began on February 21, 2025.
On February 25, 2025, the DOB released a new notice confirming that buildings marked as “NRF” (No Report Filed) for Cycle 9 can submit a Sub-cycle Override Request and file immediately, without waiting for their assigned Cycle 10 filing window.
This new option allows building owners and property managers to stop accumulating civil penalties - $1,000 per month and $5,000 per year for noncompliance - that can exceed $17,000 annually, and bring their properties back into compliance with facade safety regulations.
What’s Changed? Key Takeaways from the DOB’s April 2025 Notice
Before this update, it was unclear whether NRF-status buildings could take action before their Cycle 10 window opened. This new DOB guidance confirms that:
- Buildings that missed the Cycle 9 deadline can now be reassigned to Cycle 10 Sub-cycle A (filing period: February 21, 2025 – February 21, 2027).
- Owners must submit a Sub-cycle Override Request through DOB NOW: Safety.
- Once approved, a licensed Qualified Exterior Wall Inspector (QEWI) can file the building’s Cycle 10 FISP report immediately.
- All penalties must be paid within 10 business days of invoicing to complete the filing. If not, the report is marked incomplete and fines continue to accrue.
Note: Following early filing in Cycle 10, future FISP deadlines will revert to the sub-cycle originally assigned according to the building's block number.
