The 2024 Benchmarking Covered Buildings List is out. Owners of buildings on the list must submit their energy and water usage data by May 1, 2024, to comply with NYC Benchmarking Law (Local Laws 84 of 2009 and 133 of 2016).

Energy Audits & Retro-Commissioning: December 31, 2024
Owners of buildings with tax block numbers ending in 4 are required to submit their Energy Efficiency Report (EER) by the end of this year. A a reminder, NYC's Energy Audit and Retro-Commissioning requirement (Local Law 87 of 2009) requires property owners of buildings 50,000 square feet and larger to:
- Have an energy audit conducted on their base-building systems;
- Implement energy-audit maintenance practices as part of retro-commissioning;
- Submit an EER with the New York City Buildings Department every 10 years.
Note: The deadline for filing the EER corresponds to the last digit of the block number. For instance, buildings with tax block numbers ending in 5 must file by December 31, 2025, and so forth. The audit can be conducted up to four years before the EER is due. Therefore, owners and managers of buildings with block numbers ending in 5, 6, and 7 should initiate the process promptly to allow sufficient time for retro-commissioning measures to comply with their filing deadline.
Failure to comply with these regulations can result in penalties, starting at $3,000 in the first year and increasing to $5,000 for every subsequent year. Learn more here.
