NYC Sustainability Compliance Deadlines 2026: Key Dates, Requirements & How to Prepare

The NYC Department of Buildings’ recent Service Notice is a timely reminder that major sustainability compliance deadlines are approaching. For building owners navigating benchmarking, emissions reporting, energy audit, and Local Law 88 obligations, here’s what’s due, what comes next, and how to stay ahead of it.

Local Law 84: Benchmarking (energy and water)
Covered buildings must file annual energy and water benchmarking through EPA Portfolio Manager, as required by Local Law 84 of 2009. Benchmarking results are used to assign your building’s annual energy grade and generate the Building Energy Efficiency Rating label required under Local Law 33 of 2018 (see below).

Local Law 97: Annual greenhouse gas emissions compliance report (calendar year 2025)
Under Local Law 97 of 2019, covered buildings must file an annual greenhouse gas emissions compliance report for calendar year 2025 through DOB’s reporting process, certified by a Registered Design Professional. For filing year 2026, DOB requires the report by May 1 and no later than June 30, 2026. If needed, owners have until June 30 to apply for an extension to August 29, 2026 (subject to DOB approval). DOB also states that deadline extensions issued by service notice in 2025 do not apply to filing year 2026.

Local Law 88: Lighting upgrades and submetering compliance report
Local Law 88 of 2009 requires covered NYC buildings to upgrade interior lighting to meet NYC Energy Conservation Code standards and install tenant-level electric submeters in most large non-residential tenant spaces, then file a compliance report with DOB. DOB filing fee payments must be submitted in DOB NOW: Safety.

Local Law 33: Building Energy Efficiency Rating label posting
Building Energy Efficiency Rating labels under
Local Law 33 of 2018 are issued each year based on the prior benchmarking filing. For the 2026 posting cycle, labels will be available starting October 1 in DOB NOW and must be posted near each public entrance no later than October 31, 2026.

Local Law 87: Energy Audits and Retro-Commissioning (EER)
Local Law 87 of 2009 requires covered buildings to complete an energy audit and retro-commissioning and file an Energy Efficiency Report (EER) once every ten years. The due year is based on the last digit of the building’s tax block number:

  • 2025 compliance (tax block ending in 5): EER due March 31, 2026 (extended deadline for the 2025 filing year).
  • 2026 compliance (tax block ending in 6): EER due December 31, 2026.

A simple preparation plan for May 1 filings (benchmarking + LL97)

NYC’s building energy requirements are increasingly interconnected. Benchmarking and annual emissions reporting rely on the same underlying building and utility data, so it’s often more efficient to manage them together instead of treating them as separate, last-minute tasks.

Benchmarking: Confirm setup, access, and data (Local Law 84)

  • Confirm the building setup in EPA Portfolio Manager (single building vs multi-building/campus).
  • Lock down Portfolio Manager access early and confirm who controls the property record.
  • Gather complete whole-building utility data for the prior calendar year (typically calendar year 2025 for 2026 filings): monthly electric, gas, and water, plus delivered fuels if applicable.
  • Do a quick quality check for missing months, meter changes, or obvious anomalies.

LL97: Confirm inputs, floor area, and certification path (Local Law 97)

  • Confirm which energy sources apply and that they match what’s reflected in Portfolio Manager.
  • Confirm the gross floor area (GFA) approach used for LL97, since it affects the building’s emissions limit.
  • Confirm the Registered Design Professional who will certify the annual emissions report and allow time for review before submission.
